1. About us

PokeDownUnder ("we", "us", "our") is an Australian online retailer of sealed trading card game products, operating at pokedownunder.com and tcgdownunder.com. These terms apply to every visitor and customer of our store.

2. Eligibility

You must be at least 18 years old, or have the permission of a parent or guardian who accepts these terms on your behalf, to place an order. You agree that the information you provide at checkout is accurate and complete.

3. Orders & acceptance

• Your order is an offer to buy. A contract is formed only when we accept it — usually when we dispatch the goods.
• We may decline or cancel an order at our discretion, including for suspected resale in breach of purchase limits, suspected fraud, payment failure, stock shortfall, or a pricing or listing error.
• If we cancel an order you've paid for, we'll refund you in full to your original payment method.

4. Pricing, GST & payment

• All prices are in Australian Dollars (AUD) and include GST where applicable. Shipping is calculated and shown at checkout.
• Prices can change without notice. The price that applies is the one displayed when your order is placed.
• Payment is processed by our third-party payment providers. We don't store your full card details.
• We reserve the right to correct obvious pricing errors and to cancel and refund affected orders.

5. Purchase limits

Some products carry a per-customer purchase limit so more collectors get a fair shot at hyped releases. Limits are shown on the product page and enforced in cart and at checkout. We may cancel orders that exceed stated limits, or that we reasonably believe are placed across multiple accounts or addresses to circumvent them.

6. Stock availability

Listings are subject to availability and stock levels can change quickly during a drop. In the rare event an item sells out after your order is placed, we'll contact you to arrange a refund or an alternative.

7. Product descriptions & images

We take care to describe products accurately. Images are often supplier or manufacturer artwork and are indicative only — packaging artwork, print runs and regional variations can differ. Sealed products are sold as-is; we can't guarantee the contents, pull rates or the condition of cards inside a sealed item. Minor shelf wear to outer packaging is normal for collectible product.

8. Shipping & risk

Delivery timeframes are estimates provided by our carriers, not guarantees. Risk in the goods passes to you on delivery, or when the carrier leaves the parcel as you have authorised. See our Shipping & Delivery page.

9. Returns & final sale

All trading card game products are final sale. We do not accept change-of-mind returns, exchanges or refunds on TCG items. This does not exclude your rights under the Australian Consumer Law for goods that are faulty, damaged, incorrect or not as described — see our Refund & Returns Policy.

10. Acceptable use

• Don't use bots, scripts or automated tools to browse, add to cart or check out.
• Don't attempt to interfere with, scrape at scale, or gain unauthorised access to the site or its systems.
• Don't create multiple accounts or use false details to bypass purchase limits.

We may suspend access or cancel orders where these rules are broken.

11. Intellectual property

The PokeDownUnder name, logo, site design and original content are our property and may not be used without permission. All product names, logos and card artwork are trademarks of their respective owners (including The Pokémon Company, Wizards of the Coast, Konami and Bandai). We are an independent retailer and are not affiliated with, sponsored by, or endorsed by any of these companies.

12. Liability

To the extent permitted by law, and other than the consumer guarantees under the Australian Consumer Law which cannot be excluded, our liability for any claim relating to a product or your use of this site is limited to replacing the goods or refunding the price you paid. We are not liable for indirect or consequential loss, including loss of resale profit or change in a card's market value.

13. Privacy

We handle personal information in line with our Privacy Policy and the Australian Privacy Principles.

14. Changes to these terms

We may update these terms from time to time. The version published on this page at the time you order is the version that applies to that order.

15. Governing law

These terms are governed by the laws of Australia, and you submit to the non-exclusive jurisdiction of the courts of Queensland, Australia.
